PUD-93-02-09M 2001 Ruby Hill Bo ulevard Less Than Significant Potentially With Less Than Issues Significant Impact Mitigation Incorporated Significant Impact No Impact Noise Would the project: a) Exposure of persons to or generation of noise levels in excess of standards established in the local general plan or noise ordinance, or applicable standards of other agencies? b) Exposure of persons to or generation of excessive ~ ~ a ground borne vibration or ground borne noise levels? c) A substantial permanent increase in ambient noise levels in the project vicinity above levels existing without the project? d) A substantial temporary or periodic increase in ambient noise levels in the project vicinity above levels existing without the project? e) For a project located within an airport land use plan or, where such a plan has not been adopted, within two miles of a public airport or public use airport, would the project expose people residing or working in the project area to excessive noise levels? f) For a project within the vicinity of a private airstrip, would the project expose people residing or working in the project area to excessive noise levels? Discussion a,b,d) The proposed project would involve the use of construction equipment, such as an excavator, dump trucks, loaders, etc., and generation of construction traffic, resulting in a temporary short term increase of noise due to construction activities. These types of construction equipment normally do not produce impacts to the ground that would result in noticeable ground vibration. The increase in ground vibration will be relatively minor and of short duration. Project construction may expose the adjacent residents to construction noise if it occurs during sensitive hours. The City's noise ordinance restricts construction hours and limits noise level. The proposed development is proposed so that it would be in conformance to the City's noise ordinance. Therefore, this would be aless-than-significant-impact. c) Activities from the restaurant should not disturb adjacent residents due to its distance at 1,000 feet from closest residential properties and due to restriction of outdoor usage. A decorative wall would be constructed by the outdoor patio area to buffer noise from outdoor activities, and that the parking area would be near Vineyard with landscaping and existing vineyard to screen the noise and light. 22
