The applicant, Mr. Nagy, proposes a major modification to the Ruby Hill PUD <br />development plan to relocate the existing sales office and convert it to a restaurant, and <br />to create a future home site. He is also requesting consideration of a conditional use <br />permit to allow alcohol sales after 10:00 p.m. <br />Major modifications are subject to review by the Planning Commission and by the City <br />Council. Conditional use permits are normally subject to the approval of the Planning <br />Commission. Since the proposed modification focuses on the restaurant use, staff <br />thought it necessary to have the use permit reviewed together with the PUD <br />modification. <br />SITE DESCRIPTION <br />The subject site is a relatively flat site located on the south side of Vineyard Avenue <br />between the Mitchell Katz Winery/Palm Event Center and the signalized entrance to <br />Ruby Hill. It is approximately 36 acres in size, a vineyard property planted by Signature <br />Properties with Ruby Hill development and operated by Wente Brothers. Access to the <br />site is provided by an existing driveway from Ruby Hill Boulevard before the entrance <br />kiosk. A seasonal drainage channel running in a north-south direction bisects the <br />property. <br />Surrounding uses are the following: <br />North: Gravel Quarries (Alameda County) <br />East: Commercial (City of Livermore) <br />South: Vineyards and Ruby Hill Development <br />West: Vineyards and Ruby Hill Development <br />Site Location <br />Page 3 of 11 <br />
