three (3) days of receipt of any complaint, any action or procedure taken with respect to such complaint. 9. Insurance. The Contractor further agrees to fulfill the ~ollowing: a. Provide a Certificate of Insurance issued to the City of Pleasanton from his insurance carrier providing proof of Worker's Compensation and Policy Number. b. Provide a Certificate of Insurance from his insurance carrier showing the amount of Public liability and Property Damage coverage and naming the City of Pleasanton, its Council, employees, officers, boards and Agents as additional insureds. Insurance coverage shall be in at least the following amounts: PUBLIC LIABILITY General Bodily Injury -$5,000,000 Per Occurrence General Property Damage- 1,000,000 Per Occurrence or Combined Single Limit on Bodily Injury and Property Damage Liability - $3,000,000 AUTOMOBILE LIABILITY Bodily Injury - $1,000,000 Per Person/S5,000,000 Per Occurrence Property Damage - $500,000 Per Occurrence or Combined Single Limit on Bodily Injury and Property Damage Liability - $5,000,000 c. Provide an endorsement precluding cancellation or reduction in coverage before the expiration of fifteen (15) days after City shall have received written notification by registered mail from the insurance carrier(s). In the event of the breach of any provision of this paragraph 9, or in the event of any notices received which indicate any required insurance coverage will be diminished or canceled, City at its option may, notwithstanding any other provision of this agreement to the contrary, immediately declare a material breach of this agreement and suspend or terminate all further work pursuant to this agreement. 10. Indemnity. The Contractor hereby agrees to, and shall hold the City, its elective and appointive Boards, Commission, officers, agents, and employees, harmless from any liability for damage or claims for property damage which may arise from the Contractor's, its - 7 -
