CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 89-356 <br /> RESOLUTION DENYING THE APPEAL OFT HE CITY <br /> COUNCIL OF A DECISION OF THE BOARD OF <br /> ADJUSTMENT WHICHGRANTEDAPPROVALOF CASE <br /> V-89-11, APPLICATION OF RICH COLLINS FOR <br /> THE RETENTION OF A TRELLIS STRUCTURE <br /> <br />WHEREAS, at its meeting of June 28, 1989, the Board of <br /> Adjustment approved the application of Rich Collins <br /> for a variance from the Municipal Code to allow the <br /> retention of a trellis structure which encroaches <br /> into the required side and rear yard setback <br /> located at 1036 Bartlett Place; and <br /> <br />WHEREAS, within the time specified by the Pleasanton <br /> Municipal Code, the City council submitted an <br /> appeal to the City Clerk of the City of Pleasanton; <br /> and <br /> <br />WHEREAS, a public hearing was held before the City Council <br /> on August 15, 1989 at which time all pertinent <br /> testimony and documents were reviewed; and <br /> <br />WHEREAS, based on the testimony and documents presented, the <br /> Council makes the following findings: <br /> <br /> a. that special circumstances unique to the site <br /> can be found; <br /> <br /> b. that the proposal will not constitute a grant <br /> of special privilege; <br /> <br /> c. that the health, safety and general welfare of <br /> the surrounding area are not jeopardized by <br /> the request; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Denies the appeal of Case V-89-11, thereby <br /> granting approval of the application of Rich <br /> Collins for a variance from the Municipal Code to <br /> allow the retention of a trellis structure that <br /> will encroach into the required side and rear yard <br /> setback located at 1036 Bartlett Place, subject to <br /> the following conditions: <br /> <br /> <br />
