Resolution No. 89-325 <br />Page Two <br /> <br />Section 3: Special Conditions of Growth Management Approval <br /> <br /> In addition to development fees in effect at the <br /> time each building permit is issued, developers <br /> shall pay growth management fees of $750 per unit <br /> to offset the cumulative cost of capital facilities <br /> made necessary by ongoing residential development. <br /> <br />Section 4: Effect of Approval <br /> <br /> a. The effect of these growth management approv- <br /> als shall be to authorize development, build- <br /> ing and occupancy of the approved units and <br /> provide for the lapsing approvals in accor- <br /> dance with Chapter 17.36 of the Pleasanton <br /> Municipal Code and the other terms and condi- <br /> tions set forth in this resolution. <br /> <br /> b. This resolution does not guarantee the avail- <br /> ability of sufficient sewage treatment capaci- <br /> ty to serve the projects which have received <br /> growth management approval. Building permits <br /> may be withheld if sewage treatment capacity <br /> is determined by the City, the Dublin-San <br /> Ramon Services District or The Regional Water <br /> Quality Control Board not to be available at <br /> the time a developer applies for a building <br /> permit. In the event sewage treatment capaci- <br /> ty is not available to enable a developer to <br /> meet the development schedule approved by the <br /> resolution, the City may enact amendments to <br /> this resolution which will, as so far as is <br /> feasible, carry out the intent of this resolu- <br /> tion given the availability of sewage treat- <br /> ment capacity. <br /> <br />Section 5: Nothing herein shall lessen any obligation of a <br /> developer required as a condition of any other <br /> approvals granted by the City. <br /> <br />Section 6: This resolution shall become effective immedi- <br />ately upon its passage and adoption. <br /> <br /> <br />
