ATTACHMENT A <br /> <br /> POLICIES FOR THE AGRICULTURE/OPEN SPACE SUBAREA <br /> OF THE HAPPY VALLEY SPECIFIC PLAN <br /> October 19, 1999 <br /> <br />1. Landscape Buffers. Landscape buffer areas are to be established as appropriate within <br /> new residential developments between future homes and agricultural land to reduce the <br /> potential for land use conflicts. <br /> <br />2. Noise and Odors. Noise and odors resulting from agricultural pursuits conducted in <br /> accordance with good practice and maintenance are not deemed by the City to be a <br /> nuisance or subject to abatement. <br /> <br />3. Fire Breaks. The use of fire breaks (with maintenance service roads) shall be required in <br /> agricultural areas where appropriate and necessary for safety. <br /> <br />4. Agricultural Water. <br /> <br /> A. The City will work with Zone 7 of the Alameda County Flood Control and Water <br /> Conservation District to ensure continued water availability for agricultural land, <br /> whenever possible. <br /> <br /> B. Future urban development located in the vicinity of agricul.tural land should be <br /> designed to fully mitigate potential water quality and quantity impacts. <br /> <br /> C. The maintenance of ponds used for agricultural purposes must conform to all <br /> applicable County, State, and Federal standards. <br /> <br /> D. New private wells may be constructed to serve as a supplemental source of <br /> irrigation water. <br /> <br />5. Assessment District Fees. Fees levied against agricultural land which might be included <br /> in future assessment districts should be assessed based upon the actual benefit received as <br /> agricultural land and not upon gross acreage. <br /> <br />6. Agricultural Education. <br /> <br /> A. The City Planning and Police Departments will help to educate the community <br /> regarding local agriculture and attempt to reduce potential land use conflicts <br /> between agricultural operations and urban development through routine staff <br /> contact with the public. Information relating to trespassing, vandalism, and theft <br /> laws; damage caused by off-road vehicles; and the reporting of illegal activities <br /> should be made available to the public. <br /> <br /> <br />
