moving the existing P.G. & E. power pole and any other incidental work as <br />required by the City Engineer. <br />These changes shall be shown on the improvements plans and/or the building <br />permit plan set to satisfaction of the Planning Director and the City Engineer. <br />Unless otherwise specified, all work shall be done with the first construction <br />phase and shall be completed before occupancy of the first building covered by <br />this approval. <br />5. No vehicular access is permitted to Nevada Court by this approval. <br />6. The City shall prioritize its Pavement Management Schedule so that the <br />resurfacing of Valley Avenue between Santa Rita Road and Busch Road with <br />noise-attenuating paving material occurs before occupancy of the first building <br />covered by this approval. The project developer shall pay to the City upon <br />demand the cost differential between standard pavement material and noise <br />attenuating pavement materials. The failure of the City to complete the <br />resurfacing shall not delay occupancy of this development so long as the project <br />developer pays its share of the resurfacing cost prior to occupancy. <br />7. The property owner or its successors in interest (owner) shall enter into an <br />agreement with the City of Pleasanton (City) to provide that: <br />a. The owner shall not protest his/her inclusion in a land secured <br />improvement district created to pay the construction costs for the EI <br />Charro Road/Stanley Boulevard intersection; and, <br />b. The owner agrees to pay the development's pro-rata share on the <br />intersection's construction costs upon demand by the City. <br />If the development covered by this approval is subdivided, the agreement shall <br />be transferred to the individual property owners. <br />8. The Longs Drugs drive through may operate 24 hours per day, and is limited to <br />the sale of prescription pharmaceuticals only. All other transactions shall take <br />place inside the store. <br />9. The project developer shall provide bicycle racks for each building to facilitate <br />bicycle parking for this development in accordance with the Pleasanton Municipal <br />Code. The design and location of bicycle racks shall be shown on the site plans <br />and landscape plans to the satisfaction of the Planning Director submitted with <br />the building plans before issuance of a building permit. <br />10. Before issuance of the first building permit, the project developer shall pay for the <br />purchase of a radar speed detection device to be used on Valley Avenue <br />between Santa Rita Road and Busch Road.
