BACKGROUND <br />The City Council approved a consultant agreement with EIP Associates for professional <br />services related to the General Plan update on June 7, 2005. Under the terms of the <br />agreement, EIP Associates would prepare a Draft and Final Environmental Impact <br />Report on the General Plan and alternatives for a total cost of $133,000. At that time, it <br />was anticipated that the work would be completed by June 2006. As of April 2007, <br />approximately 9 percent of the EIR work has been completed; the balance of the work is <br />on hold until a draft General Plan document (the "project" for the purposes of the EIR) is <br />completed. Since approval of the contract, EIP Associates' hourly rates have been <br />revised twice. In addition, the contract term expired in June 2006. <br />Staff is requesting an increase in the contingency associated with this contract in order <br />to accommodate services not currently specified in the scope of work. For example, in <br />order to provide flexibility in the land use element of the General Plan, it may be <br />necessary to analyze additional land use alternatives in the Environmental Impact <br />Report. <br />DISCUSSION <br />Attachment 1, First Amendment to Agreement, makes changes to the original <br />Professional Services Agreement (Attachment 3), as follows: <br />Allows the City Manager to execute contract amendments up to a total of <br />$133,000 over and above the original contract amount of $133,000 (for a total of <br />$266,000). <br />• Amends section 4. of the Agreement to extend the term of the agreement to June <br />30, 2008. <br />• Amends section 5. of the Agreement to increase the total compensation under <br />the contract to $162,882. <br />• Replaces "Exhibit B" Budget and Hourly Rates with a revised spreadsheet dated <br />May 2, 2007, which reflect the current hourly rates for EIP Associates. <br />This amendment to EIP Associates' contract will provide sufficient time for completion of <br />the Draft and Final Environmental Impact Report and will reflect the firm's current billing <br />rates.
