MINUTES <br />CITY OF PLEASANTON <br />Special City Council Meeting <br />April 17, 2007 <br />CALL TO ORDER: Mayor Hosterman called the Special Meeting of the City Council to <br />order at 5:30 p.m. <br />2. ROLL CALL: <br />Present: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br />Absent: None <br />3. PUBLIC COMMENT: <br />Mary Roberts expressed concern about the litigation and suggested that the public be <br />included in any discussions regarding the future plans for the property in question. She <br />believed the City & School District should stay on course. <br />Laura Danielson said it was her understanding that Signature Properties was conditioned <br />to pay for the new school. She stated her support for the litigation and noted that she <br />opposed the second agreement at the time is was proposed. She clarified that the City <br />has first right of refusal of the property should a school not be built on the site. She <br />indicated her support of a park on the property, but not houses. <br />Meribeth Detweiler expressed concern with having to rely on newspaper reports over the <br />past year regarding the situation with the Neal school site. She continued by reading an e- <br />mail she sent to PUSD Superintendent Casey concerning the status of the litigation. <br />Kay Ayala said she was bothered by the holding of a closed session as she was <br />concerned with the type of discussion that would take place. She believed any agreement <br />process should be done in a public process. She reminded Council of Signature <br />Properties funding obligation for the new road and the equity for all developers. She noted <br />concern with not having outside counsel representing the City in the litigation. <br />Julie Testa expressed concern with all the new faces involved in this contentious issue for <br />a big part of the community, particularly the surrounding neighborhood. She asked that <br />the School and the City not lose sight of the resources the property has. <br />4. CLOSED SESSION: <br />Conference with Legal Counsel of the City of Pleasanton and the Pleasanton Unified <br />School District -Existing Litigation Pursuant to Government Code §54956.9(a): <br />Signature Properties et al. v. Pleasanton Unified School District, et al. -Case <br />#RG03113376 <br />The meeting reconvened in open session and it was noted that no reportable action was taken <br />in the closed session. <br />5.
