EXHIBIT A Conditions of Approval UP-90-5 November 14, 1990 This use permit is for the establishment of a self-service gasoline station, automatic drive-through car wash with air dryer, and a 920 sq. ft. convenience store as shown on the plans dated "Received, November 2, 1990" on file with the Planning Department except as modified by the following conditions of approval. The applicant shall arrange for the acoustical consultant to conduct field measurements of the noise levels at the project property line directly opposite the entrance to the car wash, six months after the car wash has began operation. A certification from the consultant shall be provided to the Director of Planning showing that the exterior noise level does not exceed 70 dBA at the property line. If the noise level exceeds this standard, then the Director of Planning may refer the subject project back to the Planning Commission for review at a public hearing. The Planning Commission may at that time attach new conditions as necessary to eliminate/minimize the problem. In the event complaints are received by the Planning Director regarding littering, loitering, noise, odors, panhandling, harassment of patrons, or other problems occurring on the site, the Director of Planning may refer the subject project back to the Planning Commission for review at a public hearing. The Planning Commission may at that time attach new conditions as necessary to eliminate/minimize the problem(s). Approval of design review application Z-90-74 by the City Council is required for this development to proceed. If the design review application fails to be approved, then UP-90-5 shall expire immediately having no further force or effect. The applicant shall pay to the City the sum of $27,000.00 for the project's pro rata share of the cost of improvements to the intersection of Hopyard Road and Owens Drive. Payment shall be made prior to the issuance of building permits to the satisfaction of the City Engineer. -10-
