3.4 Conduct public hearings and other forums required as part <br /> of the local SRRE process. <br /> <br />4. ComD~tion of Duties and Responsibilities <br /> <br />This MOU shall be deemed to have been completed on the date on <br />which the Integrated Waste Management Plan is adopted by the <br />California Integrated Waste Management Board, pursuant to the Act. <br /> <br />A fund or account shall be established by the Authority through <br />which preparation of the SRRE's shall be funded. Revenues will be <br />generated by the Authority through appropriate fees, pursuant to <br />the Act. The work funded by the Authority will be that portion of <br />the consultant's SRRE work which is required to comply with the <br />Act. SRRE work beyond said requirements, which may be requested by <br />the Agency, shall be at the expense of the Agency. <br /> <br />6. General Provisions <br /> <br />6.1 <br /> <br />Authority to Execute. The persons executing this <br />Agreement on behalf of the parties warrant that they are <br />duly authorized to execute this MOU and that by executing <br />this MOU, the parties are fore, ally bound. <br /> <br />6.2 <br /> <br />Modification. This MOU constitutes the entire agreement <br />between the parties relative to the preparation of Source <br />Reduction and Recycling Elements. This MOU may be <br />modified only by subsequent mutual written agreement <br />executed by the parties. <br /> <br />6.3 California Law. This MOU shall be construed in <br /> accordance with the laws of the State of California. <br /> <br />7. Severabilitv <br /> <br />Should any provision of this Agreement be found invalid or <br />unenforceable, this finding shall affect only that provision, and <br />all remaining provisions shall remain enforceable. <br /> <br /> <br />
