4y$~SAN~°y CITY of PLEASANTOnI <br />.~; <br />`~~~~° Planning Commission <br />~NNt~ <br />MINUTES ~OF REGULAR MEETING. <br />D Gt8 ~ January 14, 1970 <br />Time : silo PM <br />PIaCe; Pleasanton Justice Court <br />This was a reconsideration by the Planning <br />Commission of their action taken at the <br />meeting of December 10, 1969, granting <br />approval to Mr. Jim Stacy to rezone to the <br />RM-4 District and also granting to him a <br />conditional use permit for that property <br />commonly known as 3153 Vineyard Avenue, <br />Pleasanton. <br />The Public Hearing was opened by Acting <br />Chairman Pons. <br />The City Attorney provided the Commissioners <br />with the background data regarding the <br />status of this matter and the reasons why <br />the attorneys for Mr. Overpack were request- <br />ing a reconsideration. <br />The "Overpack" parcel was annexed to the City <br />in 1963. A conditional use permit was <br />granted to him in 1967 for the parcel known <br />as 3263 Vineyard. Subsequently, a conveyance <br />was executed to South Bay Land Company for <br />that parcel. A conditional use permit for <br />South Bay Land Company was granted in 1968 <br />at 3263 Vineyard. <br />The City Attorney then outlined pertinent <br />points which should be spelled out by the <br />Commission in the form of a resolution to <br />clear up the problems involved with this <br />application and the related parcel at 3263 <br />Vineyard Avenue. <br />Mr. Robert Brown, Attorney representing <br />Mr. Clayton Orr, Conservator for Mr. Overpack <br />concurred with the suggestions offered by <br />Mr. Hirst. <br />Mr. Jim Stacy, applicant, requested that <br />action be taken on the conditional use permi <br />on 3153 Vineyard Avenue, as his option on <br />that property would expire shortly, causing <br />considerable financial loss to him. <br />- 3 - <br />I. L.CU, 11 LLVL <br />legally committed. <br />Some further points were clarified with <br />both Mr. Brown and Mr. Stacy regarding the <br />effective date of the relinquishment for <br />the conditional use permit on South Bay <br />Land Company for 3263 Vineyard Avenue and <br />the subsequent reinstatement of the con- <br />ditional use permit for Mr. Overpack grante< <br />in 1967, for that parcel. <br />Also, clarification was made regarding the <br />improvements already made on that parcel <br />by Mr. Overpack and consideration given to <br />said improvements in light of attempting to <br />update the park to conform with current <br />standards and those required under Ordinance <br />No. 520. <br />- 4 - <br />
