Mr Frost stated that they have gone out of their way to meet the City's re- quirements all the way down the line, and now are in the position of needin adjustments to be made. Mr. Frost suggested that there is some good faith here and felt he should be elig ible to request these changes with that understanding. Chairman Garriga replied that the City did not force him into this position. Mr. Castro told ter. Frost that he didn't think that people that came in under the P.U.D. had any more flexibility than those under the R.O.D. The time will expire in 1972. It was reported that Morrison had the opportunity to go in under P.U.D. and the tentative could have been resubmitted. Chairman Garrigan stated that his personal opinion was that he couldn't support all of the variances that are asked for. Again discussion ensued and Mr. Frost displayed a tract map of Tract 3254. In response to a question from Mr. Castro, Mr. Frost stated that he woul not need a variance on the second phase. Mr. Frost stated that he was not asking for anything, but to get out from under the ordinance. Com- missioner Wood entered a resolution to deny said request. The resolution was passed. UP-71-21 Res.
