The City Manag <br />indicated that this would not be so as far <br />as the City is aware. The City Attorney <br />indicated that Pleasanton has virtually no <br />control on the question of priorities with <br />VCSD, apart from a negotiated agreement. <br />The Coimnission did express a desire to <br />place priority through the VCSD on all <br />commercial and industrial development <br />rather than residential. Mr. Hirst ex- <br />plained that Pleasanton can control the <br />rate at which development occurs in order <br />to more accurately gauge how growth will <br />affect the school and sewer situation. He <br />would recommend that the conditions in the <br />staff report and the phasing agreement be <br />incorporated in the final approval, and <br />that an agreement similar to what which <br />was effected with Mackay Homes be incor- <br />porated. This would include that reconsid- <br />eration of the land use would be included <br />in this agreement and provide possible <br />affixing of priorities. He indicated he <br />would be happy to take care of this matter. <br />Commissioner Hirst wished to add two condi- <br />tions. 1. That all street numbers in the <br />-- -- -- <br />subdivision be illuminated. 2. That the <br />City Attorney review and approve the <br />Homeowners Association Charter and Bylaws, <br />this to include the control of future <br />repainting of exterior colors, etc. <br />Vice Chairman Pons emphasized that the <br />Commission is reviewing this development <br />under direction of Council, and that they <br />are only reviewing the concept and the <br />design. <br />Upon resolution of Commissioner Hirst, <br />seconded by Commissioner Wood, PUD-71-1 fin <br />development plans was approved with all <br />conditions. (preliminary conditions, <br />tentative conditions, and conditions in <br />the staff report, exluding Cond. 7 and add- <br />ing: <br />12. <br />
