PIaCe: Pleasanton Justice Court priority through the VCSD. The City Manag indicated that this would not be so as far as the City is aware. The City Attorney indicated that Pleasanton has virtually no control on the question of priorities with VCSD, apart from a negotiated agreement. The Coimnission did express a desire to place priority through the VCSD on all commercial and industrial development rather than residential. Mr. Hirst ex- plained that Pleasanton can control the rate at which development occurs in order to more accurately gauge how growth will affect the school and sewer situation. He would recommend that the conditions in the staff report and the phasing agreement be incorporated in the final approval, and that an agreement similar to what which was effected with Mackay Homes be incor- porated. This would include that reconsid- eration of the land use would be included in this agreement and provide possible affixing of priorities. He indicated he would be happy to take care of this matter. Commissioner Hirst wished to add two condi- tions. 1. That all street numbers in the -- -- -- subdivision be illuminated. 2. That the City Attorney review and approve the Homeowners Association Charter and Bylaws, this to include the control of future repainting of exterior colors, etc. Vice Chairman Pons emphasized that the Commission is reviewing this development under direction of Council, and that they are only reviewing the concept and the design. Upon resolution of Commissioner Hirst, seconded by Commissioner Wood, PUD-71-1 fin development plans was approved with all conditions.
