CITY of PLEASANTON
~ Planning Commission
MINUTES ~OF REGULAR MEETING.
DGte : October 24, 1972
Time : 3:00 P.M.
PIaCe; Conference Room - City Hall
going to have to find the project
will not affect the environment or
if it will or may, it has to go ahead
and cause an environmental impact
statement to be prepared. ~~~
Mr. Hirst further explained that the
City Council, a few weeks ago, adopte
some interim guidelines pursuant to
which, pending the development of
final or permanent guidelines for
administering this act, certain
situations would be exempted from
the requirement of filing an envi-
ronmental impact report. This parti-
cular application was not one of
those that was excepted from the envi
ronmental quality report statement
requirement.
In summary, the City Attorney told
the group present that it seemed
to him that the Commission has no
business considering this application
until Council has either found that
the proposal will not have a signifi-
cant effect on the environment, or
until an environmental report has
been prepared, considered and passed j
by the City. He further explained
that the applicant had submitted an
.environmental impact statement which
is fine, but the report to be pre-
pared, must come from the City.
Mr. Hirst stated that the City is
perfectly within its rights to draw
on the factual data supplied by the
applicant, but in his opinion, a
report must be prepared by the City.
Commissioner Pereira stated then tha
in some cities, since no guidelines
have been established by the State,
an outside consultant has been hired
to prepare these impact statements.
-2-
