CITY of PLEASANTON <br />Plar+ning Commission <br />MINUT~~ ~OF REGULAR MEETING. <br />DctO 2 May 8, 1973 <br />Time ; 8:1s P.M. <br />PIGCB~ Pleasanton Justice Court <br />district preceding the current C-C <br />zone also did not allow a lumber <br />yard or contractor's storage yard, <br />which was the alleged uses made of <br />the property prior to the time <br />Geremia Pools took it over. <br />Some discussion followed, and the <br />City Attorney called the Commission's <br />attention to the ordinance code re- <br />quirements . <br />The current ordinance code specifies <br />that an existing use, although non- <br />conforming, if lawfully existing <br />prior to May 3, 1968, would be <br />deemed a valid nonconforming use. <br />',However, the existence of a lumber <br />yard or contractor's storage yard on <br />the property was not a lawfully pre- <br />iexisting use since the zoning dis- <br />~Itrict which preceded the current C-C <br />'District would not have allowed such <br />uses. Therefore, the Board of Ad- <br />justment is not in a position to <br />even consider this variance request. <br />The conclusions reached were that the <br />applicant could apply for a zone <br />change, but short of that, the appli- <br />cation as applied for, is null and <br />void. <br />jAccordingly, the matter was dismissed <br />Commissioner Pereira also recommended <br />that the City look into the possi- <br />bility of surveying some of the <br />buildings which are in a state of <br />disrepair with the thought in mind <br />Hof recommending abatement procedures <br />`for said structures. <br />?A motion was offered by Commissioner <br />;Pereira, seconded by Chairman Pons, <br />';and carried, requesting that both the <br />r -3- <br />~~~\ <br />\\\\ <br />f <br />t , <br />'s <br />i <br />~~ <br />.! <br />
