C. & R.'s were <br />submitted to the City Attorney for <br />his review. <br />Discussion centered on the C. C. & <br />R.'s and what provisions would be <br />contained therein for homeowner dues <br />and increases when necessary for ex- <br />terior maintenance of the property. <br />Mr. Lewis indicated that the manage- <br />ment is operated under by-laws which <br />may be amended by a majority vote <br />of the homeowners, thus, if the funds <br />are insufficient for maintenance, <br />they may be increased upon approval <br />of the majority vote of the residents <br />Chairman Pereira asked if this is <br />FHA "boiler plate" and Mr. Lewis <br />answered no. <br />Another question brought up by the <br />Chairman was the legality of the <br />Planning Commission reviewing tenta- <br />tive maps in view of City Council <br />directive that they not review-any. <br />He wanted Council clarification on <br />this. Secretary Harris indicated <br />that a condominium conversion could <br />not in reality be considered in the <br />same vein as a tentative tract map, <br />since it would not affect the growth <br />pattern of the City. The Chairman <br />still felt that this is a possible <br />technical violation and requested <br />clarification on it from Council. <br />The Chairman requested and received <br />a reply of no as to whether the <br />units were to be resold under FHA. <br />Mr. Pereira stated that there have <br />been some recent requirements from <br />the State Department of Housing & <br />Community Development covering <br />-12- <br />
