He promised the <br />Lindbergs that the matter would be <br />resolved. <br />The Public Hearing was then closed. <br />REZONING REQUEST <br />RZ-74-8, Approved, <br />Res. 1305 <br />In light of the past experience the <br />City has had with "abandoned" model <br />homes, a resolution recommending <br />denial of this conditional use per- <br />mit was entered and adopted. <br />,The Chairman then asked the City <br />Attorney and the Director of Plannin <br />how building permits could be issued <br />without sewer availability. Mr. <br />Scheidig stated that the permits <br />would be issued subject to the <br />obtainment of future sewer avail- <br />ability. <br />At this point, Mr. Elliott inter- <br />jected to advise the Commission that <br />the building permits have already <br />been issued and the homes are now <br />under construction. <br />Spivak Development Company - appli- <br />cation to rezone from the C-F (Com- <br />munity Commercial) District approxi- <br />mately 1.37 acres of land located <br />immediately north of the junction <br />of Santa Rita Road and Tassajara <br />Road, Pleasanton. <br />The Public Hearing was opened. <br />Mr. Chris Beratlis, representing the <br />applicant, was present, and had no <br />comments to offer. <br />No one else spoke, and the public <br />hearing was closed. <br />tesolution <br />>econded <br />dyes <br />Toes <br />absent: <br />~bs tain <br />-4- <br />
