Before construction of <br />a house could begin, variance pro- <br />cedure would need to be undertaken. <br />A resolution was then offered by <br />Commissioner Butler, seconded by <br />Commissioner Carrigan and unanimous- <br />ly carried by those present to deny <br />this tentative map submittal based <br />on Section 11549 .5 (e) of the Busi- <br />ness and Professions Code which <br />states that denial of a tentative <br />map can be made if it has been esta- <br />blished that the project would cause <br />potential substantial damage to the <br />environment. This was undertaken <br />due to the absence of a final EIR <br />which would discuss mitigating <br />factors . <br />This resolution was then amended to <br />further find that design defects <br />also exist in the form of conflicts <br />with the City's established codes <br />for design standards. <br />Acting Chairman McLain advised appli <br />cant that he has 15 days in which to <br />appeal this decision to City Council <br />At this point in the proceeding, <br />Mr. Bruno Buti of Cloverdale, owner <br />of the property under review under <br />application No. RZ-75-2, arrived <br />and asked what had transpired on <br />that application. He was so noti- <br />fied of the action taken by the <br />Commission. He then asked if the <br />staff would hazard a guess when <br />development could take place, which <br />of course, could not be established <br />at this time because of the City's <br />sewer moratorium. <br />-13- <br />
