He feels pro- <br />perty owner should have the right to <br />a final map in accordance with zoning <br />for that property, subject to all con <br />ditions laid out in staff report. <br />There being no further comments, a <br />resolution recommending denial per <br />Exhibit D (sample resolution) was <br />entered and adopted, with Commissione <br />Doherty voting no, and the others yes <br />Parcel Map 1453 - Frank Auf der Maur. <br />Secretary Harris explained that at <br />the applicant's request, this matter <br />was being withdrawn. <br />City Attorney Scheidig explained that <br />sometime ago, the Commission reviewed <br />property at Stanley and Vervais . One <br />condition of approval was removal of <br />easement for sewer purposes which ran <br />across the property. This was re- <br />viewed by applicant's representative, <br />Bill Hirst, who has attempted to find <br />,out about this easement and apparentl <br />it was issued to a person whom they <br />..cannot locate at this time, despite <br />',efforts to do so. In addition, <br />P.G.&E., has destroyed all their <br />',records, since this recording is <br />(more than seven years old. <br />j The developer agreed to hold the <br />'City harmless from disputes arising <br />.from any building on the sewer ease- <br />ment if this should occur in the <br />I future . <br />-12- <br />
