"""'°° CITY of PLEASANTON <br />Planning Commission <br />MINUTES ~OF REGULAR MEETING. <br />Dote : December 10, 1975 <br />Time : 8:00 P.M. <br />PIOCe: Pleasanton Justice Court <br />ROLL CALL <br />APPROVAL <br />OF MINUTES <br />REZONING REQUEST <br />RZ-75-5, Recom- <br />mended for ap- <br />proval, Res. 1383 <br />Commissioners Present: Butler, <br />Doherty, Carrigan, Shepherd and <br />Chairman Wood. <br />Commissioners Absent: None. <br />The minutes of the meetings of Octo- <br />ber 29, 30 and November 12, 1975, <br />were approved as submitted. <br />Spivak Properties - application to <br />rezone from the A (Agricultural) <br />District and P (Public and Institu- <br />tional) District that approximate 5. <br />acre parcel of land located immedi- <br />ately east of Hopyard Road and north <br />east of the First National Bank of <br />Pleasanton drive-in facility. The <br />western approximately two-thirds of <br />the property would be designated a <br />C-C District; the eastern approxi- <br />mately one-third would become a P <br />District. <br />Secretary Harris provided the Com- <br />missioners with background on this <br />case. The property owner, at this <br />time, has no definite tenant for <br />either site but negotiations are in <br />progress to accomplish this. Staff <br />recommended approval subject to two <br />conditions. However, in later dis- <br />cussions with the City Attorney, it <br />was his opinion that both conditions <br />should be dropped as he felt that <br />the City should not encumber itself <br />at the rezoning stage with such con- <br />ditions. The same intent of the con <br />ditions can be met by noting the <br />conditions in the minutes and then <br />notify the property owner that the <br />City would not want to have this com <br />mercial zoning sit there undeveloped <br />indefinitely. <br />
