Mr. Harris stated this was the same recommendation which was made <br />with regard to the initial Deer Oaks proposal and the Commission recom- <br />mended to Council that there be no more than three lots on the Twelve <br />Oaks cul-de-sac. The reason being four lots, would allow houses to <br />be much closer together than the other homes that are now being <br />built in the area. He stated Mr. Dunkley has removed one of the lots <br />on Twelve Oaks Drive allowing there to be four lots and in order to <br />keep the number at 24 he took that lot and put it down and reduced <br />the size of the lots on the flat land area from a minimum lot size <br />of 25,000 sq. ft. to 22,000 sq. ft. When this was considered before, <br />Mr. Dunkley asked for 24 lots; staff and the Commission recommended <br />to Council that there be 21 lots. Council approved 23 lots and <br />now Mr. Dunkley is again requesting 24 lots, but one lot on Twelve <br />Oaks Drive has been moved and reduced the number from 5 to 4 because <br />that was what the Council approved and then the lot was moved adjacent <br />to the lots on Foothill Road. Mr. Harris continued to say that the <br />other lot, to make up the difference, which is now Lot No. 7 which <br />had been redesigned after initial submittal, has been provided access <br />off the cul-de-sac. Staff now agrees with this and is now recommending <br />22 lots as opposed to 21 before. <br />Commissioner Jamieson stated that from the standpoint of the Com- <br />mission that he felt staff should be allowed to decide which lot <br />should be eliminated. <br />Commissioner Jamieson referred to page 22 of Volume II of the EIR <br />and comments made by Plummer and Associates. He stated they refer <br />to double glazing and asked if double glazing will be required on <br />all homes. Mr. Harris stated it is uncertain at this time, but he <br />felt in this case they would probably have to have the double glazing <br />or there might be other options to meet the new State energy require- <br />ments. Mr. Harris further stated that we are not recommending this <br />in any of our conditions. <br />Commissioner Jamieson also commented on page H-2 of the EIR and a <br />comment by the Currator Assistant of the California Archeological <br />Inventory. He stated they recommend that a qualified archeologist <br />conduct a strategy field survey prior to development of the project. <br />Mr. Harris stated staff is not recommending this be done, but is <br />recommending that they stop construction if they dig up artifacts <br />and have them analyzed before continuing. <br />Commissioner Jamieson asked if when comments such as these are <br />received from an outside agency we have to follow them. Mr. Harris <br />stated we are required to comment on them but we do not have to follow <br />their recommendations, depending upon whether the impact is deemed to <br />be significant or insignificant, then we are required to do certain <br />things and take certain actions with regard to significant impacts. <br />Commissioner Jamieson referred to condition number 47 regarding fire <br />retardant material on the roofs and sidings and asked Mr. Harris <br />if shake roofs would be approved.
