Page 12 <br />next meeting. Commissioner Lindsey asked if the public hearing should <br />be reopened. Mr. Swift indicated this would be an excellent idea. <br />Chairperson Lindsey then reopened the public hearing. <br />Lee Henderson, Foothill Road, addressed the Commission. He suggested <br />this matter be held in limbo for the the outcome of the HPD. He said <br />nothing has been taken from the HPD experience and applied to this <br />proposed PUD action. <br />Mr. Harris said this is the same project which was approved nine months <br />ago. He said staff is recommending approval of 22 units because staff <br />feels now and has always felt that in the aggregate it is a good plan. <br />He said originally staff recommended approval of 21 units. <br />Mr. Henderson said the proposal doesn't speak to the pad. <br />Mr. Harris said in the main these house sites will be on land less <br />than 25$ slope. He said there may be one or two instances where this <br />will not be the case. <br />Mr. Henderson again requested a moratorium on all of the hillside until <br />guidelines or an ordinance is established. <br />John Innes, 1586 Foothill Road, said the lands west of Foothill are <br />unique. He said there are also some unique lands on the east side. <br />He said he believes an HPD is needed in some form. He said he is <br />neither for nor against the proposal but is against the timing because <br />City Council has not made a decision on the hillside ordinance. <br />Art Dunkley, Castlewood Properties, rebutted the statements made. He <br />said it makes no sense to put off action when there would be very little <br />or no change to his proposal. <br />Commissioner Doherty spoke to the calculations done by Mr. Glenn. <br />Mr. Doherty went to the map on the wall and spoke to alternatives to <br />reduce lots and make more open space. <br />The public hearing was closed. <br />Commissioner Lindsey said the project makes sense to him for the area. <br />Commissioner Getty supported the project previously and stated she <br />supports it now and that many concerns can be addressed through CC&Rs. <br />She was interested, however, if this were to be the case, eliminating <br />the common open space and making it private. <br />Mr. Harris stated he would recommend that the applicant come back with <br />a map showing the new lot lines. <br />Mr. Swift spoke to private and common open space. He said with regard <br />to private open space, one can contact an owner with a problem and with <br />common open space you would address concerns to an association. <br /> <br />
