Mr. Wong spoke again stating they are not excavating at this time but that dirt is being spread over their property from the drainage channel currently being modified. He further said the City has notified him of dust problems in the area and he has worked to eliminate them. Commissioner Wilson then asked Mr. Wong if the widening of the flood channels would mean the new development would not require flood insurance. Mr. Warnick said it will reduce the flood level by about 2 ft. Mr. Slaus of Hansen Drive spoke again stating that the excavation has been on the west side of I-680 and asked about the flood zone. Mr. Warnick said the flood level would be reduced from two to three feet in the entire area and that all building pads in the area will be above the flood plain. The public hearing was then closed. A motion was made by Commissioner Getty, seconded by Commissioner Wilson, that the Mitigated Negative Declaration prepared for Tract 4986 be adopted inasmuch as conditions imposed on project approval would reduce any significant adverse effect to an insignificant level as related to flood and noise. ROLL CALL VOTE Ayes: Commissioners Doherty, Getty, Wilson and Vice Chairperson Jamieson Noes: None Absent: Chairperson Lindsey Abstain: None Resolution 2231 was then entered and adopted approving the Mitigated Negative Declaration for Tract 4986 as motioned. A motion was then made by Commissioner Doherty, seconded by Commissioner Getty, that Tract 4986 be approved subject to the conditions of the staff report of 10/13/82 changing condition No. 7 regarding the maintenance, etc. of the landscaping.
