<br /> <br />10/27/82 <br />Planning Commission <br />Minutes <br />Page 7 <br />A motion was made by Commissioner Getty, seconded by Commissioner <br />Doherty, that case PUD-82-22 be recommended for approval subject <br />to the conditions of the staff report. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, <br />Chairperson Lindsey <br />Noes: None <br />Absent: Commissioner Wilson <br />Abstain: None <br />Getty, Jamieson and <br />Resolution No. 2239 was entered and adopted recommending approval <br />of case PUD-82-22 as motioned. <br />MATTERS FOR COMMISSION'S REVIEW <br />Report on Video Games <br />Mr. Harris presented the staff report. He indicated his staff had <br />talked to Mr. Brad Hirst of the Game Station and others in putting <br />the report together. <br />Commissioner Doherty asked if machines in homes would be inventoried <br />and taxed as suggested for the commercial users in the staff report. <br />He felt that one might be opening 'Pandora's Box' in taxing machines. <br />Mr. Harris stated that unless they were a commercial business the <br />City wouldn't want to license them. Commissioner Doherty asked <br />the definition of commercial. He said that in apartment complexes <br />there are cigarette machines and coin operated laundries for profit. <br />Mr. Swift stated that currently businesses aren't allowed in resi- <br />dential districts. <br />Chairperson Lindsey discussed expansion of non-conforming uses and <br />asked if, as proposed, would Chuck E. Cheese, for example, have <br />to come before the Planning Commission if they increased their use <br />by one machine. Mr. Harris indicated they would be operating <br />under a non-conforming situation and would have to come before the <br />Commission. Mr. Swift indicated that allowable expansions under <br />non-conforming use statutes are usually judged in terms of square <br />footage, additional parking spaces required, etc. The City's <br />particular provisions would have to be reviewed to determine what <br />percentage increase in the number of machines would be deemed an <br />illegal expansion of a non-conforming use - in these cases neces- <br />sitating application for a conditional use permit. <br />
