Chairman Butler inquired as to what the nonconforming uses were and was <br />told they comprised two wrecking yards and several residences. <br />Commissioner Wood brought up the question of non-conforming uses versus <br />reimbursement to owner in case of a fire, and how would the owner of the <br />business fare. Deputy City Attorney Levine indicated that he felt certain <br />a court of law would make sure they would not lose everything. <br />Also, Commissioner Jamieson wished to confirm that no existing uses would <br />be forced out. <br />The Public Hearing was opened. No one spoke to the matter, and the Public <br />Hearing was closed. <br />Resolution 1460, recommending to the City Council that the property involved <br />in Annexation 71 be prezoned to City of Pleasanton C-S (Commercial Seririce) <br />District property. <br />Roll Call Vote: <br />Resolution: Commissioner Wood <br />Seconded: Commissioner Doherty <br />Ayes: Commissioners Doherty, Jamieson, <br />Noes: None <br />Absent: Commissioner Shepherd <br />Abstain: None <br />Wood and Chairman Butler <br />RZ-76-20, Planning Commission - Application to rezone from the A (Agricultural) <br />Dist it ct to the C-C (Central Commercial) District an approximately 0.65 <br />acre parcel of land located at 3534 Santa Rita Road, approximately 225 feet <br />north of the intersection of Santa Rita Road and Tassajara Road. <br />Secretary Harris explained that this case is an adjunct to the previous case, <br />and since all the land surrounding it is commercial, it is staff's suggestion <br />to rezone this property to commercial as a housekeeping matter, to bring it <br />into conformity with the General Plan. Some discussion ensued regarding in- <br />crease in taxes for the property owner and it was stated that the Assessor's <br />office does not base taxes on zoning but on sale of a like use in the area. <br />The Public Hearing was opened, no one spoke to this matter and the Public <br />Hearing was closed. <br />Resolution Pdo. 1461 was then entered and adopted recommending to the City <br />Council that this property be rezoned from the A (Agricultural) District to <br />the C-C (Central Commercial) District. <br />Roll Call Vote: <br />Resolution: Commissioner Wood <br />Seconded: Commissioner Doherty <br />Ayes: Commissioners Doherty, Jamieson, Wood and Chairman Butler <br />Noes: None <br />Absent: Commissioner Shepherd <br />-2- <br />
