explained the legal ramifications, and it was concluded that review <br />by the Commissioners at this time would be proper. <br />Resolution No. 1468 was entered and adopted recommending this general <br />plan amendment to the City Council. <br />Roll Call Vote <br />Resolution: Wood <br />Seconded: Jamieson <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood and Chairman Butler <br />V-76-19, Mini-Systems, Inc. - application for a variance to Sec. 2-5.35, <br />Article 3, Chapter 2, Title II of the Ordinance Code of the City of <br />Pleasanton to allow the construction of an industrial building which <br />would encroach into the required yard setbacks of the lot located at <br />5726 Sonoma Drive; zoning for the property is I-P (Industrial Park) <br />District. <br />Secretary Harris explained that this lot was created prior to the <br />1968 Zoning Code, and is substandard by today's requirements. <br />The Public Hearing was opened. <br />Mr. Jack Bras, spoke to this application, agreeing with all staff <br />comments in the report. <br />The Public Hearing was closed. <br />Resolution No. 1469, approving this variance subject to conditions <br />and findings was entered and adopted. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Doherty <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent: None <br />Abstain: None <br />Shepherd, Wood and Chairman Butler <br />Z-76-180, Mini-Systems, Inc. - application for design review approval <br />to construct an industrial building to be located at 5726 Sonoma Drive; <br />zoning for the property is I-P (Industrial Park) District. <br />Commissioner Wood had a question regarding Condition #8 and Commissioner <br />Jamieson had a question regarding Condition #17, and Secretary Harris <br />explained. Commissioner Jamieson wondered if an agreement on land- <br />scape maintenance should be a part of this approval. <br />The Public Hearing was opened. <br />Mr. Jack Bras, speaking for his clients, stated that he disagreed <br />with Condition #17. This condition requires that it be recorded on the <br />title deed. It was his position that this requirement should be ex- <br />tracted for all commercial developments. He felt the property owner <br />should dictate the appearance of his property. <br />-7- <br /> <br />
