Roll Call Vote
Resolution: Doherty
Seconded: Shepherd
Ayes: Doherty, Jamieson,
Noes: None
Absent: None
Abstain: None
Shepherd, Wood and Chairman Butler
REFERRALS FROM ALAMEDA COUNTY
Secretary Harris informed the Commission of the material just received
regarding the Livermore-Amador Valley revision to the County General
Plan. Because of the short review period afforded, both Livermore and
Pleasanton have requested that no definite action be taken by the County
at the present time. Mr. Harris pointed out the critical sections
which would need to be reviewed by the Commissioners. There is another
hearing scheduled for November 16 at Foothill High School at 7:30 P.A1.
MATTERS FOR INFORMATION OF COMMISSION
Reminders were given for several meetings - Growth Management Meeting
on November 15, and joint Commission/Council meeting on November 29.
Another matter brought up was from Mr. Levine regarding his November 10
memorandum on making required findings. The Commissioners thanked him
for his efforts.
It was the consensus of opinion that an orientation meeting for new
Commissioners would be helpful in alleviating these types of questions.
The question raised by Commissioner Wood last week on the issue of
possibility of rebuilding structures whose zoning has become non-
conforming and which have suffered more than 50~ damage, was discussed,
and Mr. Levine explained the several ways it could be dealt with.
Mr. Levine also researched a question raised at the previous meeting
by Commissioner Jamieson regarding the City having to abide by its own
codes, and the answer was yes. However, the ordinance is so written
that it also requires State, Federal and County governments to abide
by City ordinances. This is clearly out of line with existing case
law and State statutes, therefore, to make the requirement of the
City to abide by its own ordinances clear and unchallengeable, that
section of the code should be rnodified.
A motion was entered by Commissioner Doherty, seconded by Commissioner
Jamieson and unanimously carried, that the ordinance be amended to
that effect.
Secretary Harris informed the Commissioners that staff is still
researching the best method to notify surrounding property owners.
MATTERS INITIATED BY COMMISSION MEMBERS
Commissioner Wood asked staff research as to possible rerouting of
traffic going into First National Bank. He wondered about entering
the site from St. John Street only, and exiting on Main. No discussion
-11-
