Condition #2 would need the same modification options as in <br />the Design Review Board conditions - that being the property owner would <br />accept approval per his original submittal which would mean the possibility <br />of closing off the rollup door if and when the multiples on the adjacent <br />property develop, or redesign the ?Mans to place the building on the <br />southerly property line. <br />The Public Hearing was opened. <br />Mr. Bill Hirst, 147 Bernal Avenue, spoke for the proponent, indicating <br />acceptance of the staff report with the conditions and options as discussed <br />by Mr. Harris. <br />The Public Hearing was closed. <br />Resolution No. 1473 was then entered and adopted approving UP-76-3U, subject <br />to the conditions in the staff report, plus the wording allowing the appli- <br />cant the option to move the building placing it on the southerly property <br />line. <br />Roll Call Vote <br />resolution: ~~7ood <br />Seconded: Shepherd <br />Ayes: Doherty, Jamieson, <br />Noes: None <br />Absent : clone <br />Abstain: idone <br />Shepherd, Wood, Chairman Butler <br />UP-76-31, Oak Tree Center - application for a conditional use permit to <br />allow the construction and use of a shopping center complex on a site located <br />west of the rear of residences on Longspur Way, south of the Pleasanton Canal <br />and north of Valley Avenue. The shopping center complex would require some <br />required off-street parking to be located on P (Public and Institutional) <br />District land located between the proposed shopping center and the resi- <br />dences on Longspur Way. Zoning for the site is C-C (Central Commercial- <br />3.6 ac.) and P (Public and Institutional-1.8 ac.) District. <br />Secretary Harris told the Commissioners that although the Public Hearing <br />was closed, they could go ahead and receive additional testimony if they <br />wished. They agreed to do this. <br />Their concerns expressed at the last hearing were reiterated as being traffic <br />circulation within the complex and access to the site. A traffic circulation <br />olan for roads adjoining the site prepared by the City Traffic Enq_ineering <br />Division was displayed. The z~lan showed two median breaks on the northwest <br />boundary of the site on Hopyard Road. The proposal is for left-turn into <br />the site from Hopyard Road, but no left-turn from the site onto Hopyard Road, <br />also left turn on Valley Avenue exiting the site, but no left-turn ingress <br />into the site. <br />Some discussion ensued regarding how traffic from the Alpha Beta Center would <br />get from that center to the Oak Tree development, and Per. Sooby described <br />how the traffic would maneuver between the two developments. <br />Regarding access from Hopyard Road, Commissioner Doherty again expressed <br />his concern regarding stacking up of traffic during certain hours of the <br />-2- <br /> <br />
