Next, a Jerry Suda of San Leandro, spoke requesting favorable consideration <br />of this application. <br />Mr. Chris Beratlis, owner of the adjacent property, then related his attempts <br />to resolve the mutual easement problems, to no avail. He stated he had no <br />quarrel with the tenants of the building but that he needed a solution to <br />the parking situation, particularly the blocking of the driveway by the new <br />owners. <br />A Mr. Doug Paul of San Ramon expressed some concern regarding traffic con- <br />gestion at the location. <br />Gary Barber, 286 McCloud Street, Livermore, one of the owners of the building, <br />spoke. He stated that the building has been vacant for seven-eight months, <br />that original plans called for a mall of 14-15 stores. But they decided the <br />best arrangement would be to have lesser number of tenants. Now, they have <br />two tenants toward the front of the building, with the dance studio planned <br />for the rear. He also gave a brief description of the arragnements he has <br />for his tenants for use of the parking lot. He conceded that there may be <br />some inconvenience to the print shop on Mr. Beratlis's property whenever the <br />furniture store receives a shipment, but he did not feel that the problem <br />could not be settled. He indicated complete willingness to sit down with <br />Mr.Beratlis to work out this situation. <br />Commissioner Shepherd asked whether access to the studio could be provided <br />from D4ain Street entrance, and Mr. Barber replied that this would not be <br />feasible. <br />Secretary Harris indicated some problems with finaling of the building before <br />occupancy could occur, that there are some illegal occupancies because of <br />this. Also, there is an illegal sign on the front of the building. <br />Next, Rick Corbette, 2498 Mary Place, Livermore, one of the owners of the <br />building, spoke. He stated that there is a $600 bond on the property to <br />cover uncompleted work, however, they have not received contact from the <br />City advising them of what exactly needs to be done. They are well aware <br />of their obligations to the City. He indicated that he had worked out a <br />"gentlemens agreement" with Mr. Beratlis in December, and would be willing <br />to sit down again to work out their problems. <br />The Public Hearing was closed. <br />Commissioner Doherty felt a mutual agreement should be worked out between the <br />two property owners, with said agreement to be reviewed and approved by the <br />City Attorney's office. <br />Considerable discussion ensued regarding how the matter could be settled. <br />It was finally agreed that the conditional use permit could be granted for <br />the dance studio subject to the two conditions in the staff report.
