Review of Tentative Tract Map #3897, Page Binkle~ <br />Secretary Harris stated that technically, the Planned Unit Development <br />zoning does not exist on this property, since adoption of the ordinance by <br />City Council has not gone into effect. It was the City Attorney's opinion <br />that because of this technicality, the Planning Commission probably should <br />not take action on the map. If action is not taken on the map within 50 <br />days, the map would be deemed approved.. However, the applicant could agree <br />to waive the 50-day period. Otherwise, the Commission would need to deny <br />the map. <br />Mr. Page Binkley was present and agreed to an extension of time and to waive <br />the 50-day period. He indicated that he would be amenable to having the <br />map reviewed at the September 14 Planning Commission meeting. <br />Accordingly, this matter was continued until that time. <br />REFERRALS FROM CITY COUNCIL <br />A. Councilmember Frank Brandes explained some of the items which Council is <br />reviewing under the budget. Council had to consider utilization of some <br />surplus monies. The Mayor appointed Councilmembers Brandes, Herlihy and <br />Mercer to review several possibilities - purchase of Fire Station #2, a new <br />location for the Police Station. In conjunction with relocating the police <br />headquarters, would be utilization of its existing headquarters. <br />Councilmember Brandes welcomed any comments, suggestions from the Planning <br />Commission . <br />B. Councilmember Brandes told the Commissioners that Councilmember LeClaire <br />had appealed the conditions of approval for ambulance service application <br />established by the Planning Commission at their special meeting of June 29. <br />He seconded that motion because he felt that any member of the City Council <br />should have the right to appeal a case. <br />He was looking for possible alternatives such as parking the ambulance in <br />a parking stall of the adjacent apartment complex. It was his understanding <br />that the objections of adjacent R-1 neighbors was the appearance and visi- <br />bility of the ambulance, and relocating the ambulance location may deter <br />some of those objections. <br />Commissioner Wood conceded a Councilperson`s right to consider deletion of <br />a condition, but it should be kept in mind that an application may receive <br />sanction from the Planning Commission subject to certain conditions, said <br />sanction perhaps not being given had the conditions not been a part of the <br />approval. <br />Commissioner Doherty stated that he was not present at that special meeting, <br />but had he been present, he would have sided with Commissioner Jamieson in <br />voting no, as he did not feel residential neighborhoods are appropriate <br />for such types of services. <br />Regarding parking the ambulance in the apartment complex lot, Commissioner <br />Doherty felt this might be acceptable providing the vehicle exited the area <br />from Mohr Avenue. <br />-10- <br /> <br />
