Considerable discussion ensued among the Commissioners regarding appeal <br />provisions if an applicant did not agree with the determination of the <br />Zoning Administrator as noted under Draft Ordinance A. Secretary Harris <br />explained that the code does make proivsion for appeal either to the Board <br />of Adjustment, Planning Commission or City Council. <br />This ordinance amendment review came about as a result of Mr. Frank Auf <br />der Maur's application for a medical office building within the Cedarwood <br />complex, which would be for plastic surgery practice. Previous testimony <br />made it apparent that the patient turnover is considerably less than that <br />experienced by a general practitioner. <br />The Public Hearing was opened. <br />Mr. Mullen, Mullen-Morris-Alexander, architects for Mr. Auf der Maur's <br />project, was present and asked for clarification of the appeal section of <br />the code. Mr. Levine confirmed that such a procedure is in the code. <br />The Public Hearing was closed. <br />Commissioner Shepherd indicated he was in favor of Draft Ordinance A, as it <br />provided sufficient flexibility. Commissioner Jamieson concurred. <br />Resolution No. 1623 was entered and adopted initiating an amendment to <br />Sec. 2-9.15 (c) of Article 16, Chapter 2, Title II of the Code which would <br />give the Zoning Administrator discretion to impose parking requirements for <br />those uses not listed in the code, and to recommend to the City Council <br />adoption of Draft Ordinance A, which would accomplish this amendment. <br />Roll Call Vote <br />Resolution: Shepherd <br />Seconded: Jamieson <br />Ayes: Jamieson, Shepherd, Chairman Butler <br />Noes: None <br />Absent: Doherty <br />Abstain: None <br />RZ-77-16, City of Pleasanton - Application of the City of Pleasanton to <br />prezone a 13.6 acre parcel of land located on the north side of Stanley <br />Boulevard bounded on the north by the Western Pacific Railroad and on the <br />east by the Southern Pacific Railroad to the C-S (Commercial Service) <br />District or any other zoning district which the City finds to be appropriate <br />and in conformance with the General Plan. <br />Application continued until May 10, 1978, meeting. <br />GP-78-1, City of Pleasanton - Review of a negative declaration for a Safety <br />Element of the Pleasanton General Plan. <br />Application for the adoption of a Safety Element to the Pleasanton General <br />Plan which would contain goals, policies and implementation programs with <br />respect to protection from fire, flood, geologic and nuclear hazards. <br />Secretary Harris gave a brief explanation of the project.
