Bernard Ching was present and stood ready to answer any questions. <br />The Public Hearing was closed. <br />Resolution 1648 was entered and adopted approving UP-78-14, subject to the <br />findings and conditions in the June 14, 1978, staff report. <br />Roll Call Vote <br />Resolution: Doherty <br />Seconded: Geppert <br />Ayes: Doherty, Geppert, <br />NOes: None <br />Getty, Wilson, Jamieson <br />D'IATTERS FOR COMMISSION' 8 REVIEW <br />?•4S-78-10, Harry Hempy - review of request for a minor subdivision for <br />property located at 4444 and 5000 Foothill Road; zoning for the property <br />is A (Agricultural) District. <br />Secretary Harris described the June 14, 1978, staff report and recommended <br />that approval be given to reconstitute property lines to create two parcels, <br />Parcel C and combined Parcels A and B as shown on Exhibit A, Boundary Adjust- <br />ment Map, subject to the conditions in the report. <br />Considerable discussion took place between the applicant's engineer and <br />the Commissioners. <br />Mr. Hempy, also present at the hearing, stated that he did not concur with <br />the action taken by the Board of Adjustment earlier in the evening. <br />City Attorney Levine advised the Commissioners that they could not take <br />action on tlhc~ oarcel rzap as requested because of the denial of the variance <br />by the Board o.f"Adjustment. <br />After further discussion, Mr. Hempy indicated he would prefer to appeal <br />the decision of the Board of Adjustment, so the minor subdivision review <br />was continued pending City Council action on the appeal. <br />Review of revised Five-Year Construction Program by Alameda County Fair <br />Association - Commissioner Wilson, a board member on the Fair Association, <br />explained the priority schedule and capital improvement program submitted. <br />He indicated that for the next year, probably the only construction which <br />would take place would be Priority Item No. 1 - Amador Pavilion. <br />Previously, the Commissioners had expressed a desire to see the amphi-theatre <br />covering constructed. But since last year's schedule, the item has moved <br />up by only one place. <br />-2- <br />
