A con- <br />ditional use permit is needed to control the hours of operation, etc. <br />Mr. Harris then stated that this has been going on for six months and <br />that an entirely new zoning district was created for the shopping center. <br />Ninety percent (90~) of the uses are allowed and that the development <br />company would like to have 98~. All other zoning in the City has con- <br />ditional uses. They are shown that way because a particular use may not <br />be deemed appropriate in each instance. Supermarkets are appropriate <br />in some areas and not in others. If we were to make them permitted, <br />then they are permitted in any areas which are zoned the same. <br />The Public Hearing was closed. <br />Mr. Wilson then moved to recommend approval to Council of RZ-77-19 <br />subject to the two changes as shown in the memorandum of September 27, <br />1978 which amends the staff report dated August 9, 1978 as requested <br />by Mr. Brad Hirst and subject to food stores and hotels and motels <br />being permitted rather than conditionally permitted uses in the CR(P) <br />District. <br />Resolution No. 1685 was then adopted recommending to City Council approval <br />of RZ-77-19 per the staff report with the addition of the two items <br />shown in the memorandum of September 27, 1978 which was incorporated <br />into the staff report. <br />Roll Call Vote <br />Resolution: Wilson <br />Seconded: Doherty <br />Ayes: Wilson and Acting Chairman Doherty <br />Noes: Geppert <br />Absent: Getty_and Chairman Jamieson <br />Abstain: None <br />RZ-77-12, Scenic Highways was moved to the bottom of the Agenda <br />UP-78-21, Kay Watson <br />Application of Kay Watson for a conditional use permit to operate a day <br />care and nursery school facility in the existing building located at <br />1251 Hopyard Road. Zoning for the property is P (Public and Insti- <br />tutional) District. A negative declaration was also considered. <br />Secretary Harris reviewed the staff report recommending approval of <br />UP-78-21 subject to 12 conditions as shown on the staff report. Mr. <br />Harris then stated he had discussed with the applicant their desire to <br />extend the fence to within 20 feet of the property line. Fencing should <br />not come any closer than 40 feet because-landscaping would have to be <br />removed. <br />-3- <br />
