Mr. Harris reported that this item has been continued since August 9 <br />because of the absence of Commissioners Getty and Chairman Jamieson. Mr. <br />Harris stated Mr. Jamieson has been ill and his doctor has instructed <br />him to stay inactive for at least one more month. <br />Mr. Harris then presented two changes to the staff report which were made <br />at the request of Brad Hirst at the Planning Commission of September 13, <br />1978. These two changes were incorporated into the staff report in a <br />memorandum dated September 27, 1978 to the Planning Commission from the <br />Director of Planning and Community Development. These items are: <br />1. Financial institutions - Conditionally allowed in C-A; 2. Recreation <br />and sports facilities indoors - Conditionally allowed in C-S. The balance <br />of changes proposed by Mr. Hirst did not meet C zoning requirements. <br />Mr. Wilson referred to the October 1, 1974 schedule and the conditional <br />and permitted uses at that time. Mr. Wilson stated the developer should <br />have leeway in obtaining motel users without telling the prospect that <br />the agreement would be subject to a conditional use permit. He further <br />stated that we are looking at a very large development. <br />The Public Hearing was opened. <br />Mr. Naggar, AIA, for Stoneridge-Taubman spoke stating he was concerned <br />with conditional uses now before the Planning Commission. He stated the <br />entire project was zoned Regional in 1972 and as late as 1974 the City <br />permitted uses which they are now restricting; namely, supermarkets and <br />motels. He stated he has talked to Bob Harris about their concerns with <br />respect to these and other uses. He stated he believes Bob Harris is <br />looking at this situation from the City's view with regard to zoning <br />restrictions. Mr. Naggar stated that they control the development very <br />carefully. He also stated that they have demonstrated this throughout <br />the County. Mr. Naggar said that they put very severe restrictions <br />themselves on all development of the periferal land because it is the <br />"Window through which one sees the center." <br />Mr. Naggar presented a map and explained the proposed periferal uses. <br />He stated that the Stoneson Company only wants one hotel/motel site on <br />the perifery. <br />Mr. Wilson then asked Mr. Naggar if motels and hotels were permitted <br />in the center, what would prevent you from putting a hotel where a <br />convenience center is shown. Mr. Naggar responded he would be happy <br />to show the Commission the agreement which they have signed for this use. <br />Mr. Naggar then presented Mr. Art Schumacher of the Stoneson Development <br />Company, San Francisco. Mr. Schumacher then said that the motel site, <br />although in the CR zoning is owned entirely by the Stoneson Corporation. <br />They have an agreement with the potential developer of the motel that <br />it will not be developed elsewhere on the property other than where <br />they propose to develop it. He further said that after 14 years, there <br />is now a change in things for this particular piece of property. Mr. <br />Schumacher said he had an offer on the property which is conditioned upon <br />the sewer and use permit. This offer was made sometime ago. Mr. <br />Schumacher then stated he wrote a letter to Mr. Harris to which he has <br />never received a reply. <br />-2- <br />
