PLANNING COMMISSION MINUTF <br />April 11, 1979 <br />as the creek would be retained in a natural state. In answer to Commissioner Doherty's <br />question, Mr. Fairfield stated that Stoneson owned all of the property in one parcel <br />immediately west of the proposal. Sue Langhans of Chestnut Way spoke concerning this <br />project as she had concerns with gas stations and related commercial development <br />eliminating the natural environment. Chairman Jamieson assured her that this would not <br />be done and that any potential change would require a public hearing. Mr. Harris <br />stated that any property could be rezoned, but that it is highly unlikely this property <br />would be rezoned commercial. Mrs. Langhans stated she would like to see this zoned <br />Planned Unit Development. Commissioner Doherty then explained the processes for <br />changing the land use designation, rezoning then the submittal of a development plan. <br />Public hearing was then closed <br />A motion was made by Commissioner Wilson, seconded by Joyce Getty that a negative <br />declaration of environmental impacts be filed for RZ-79-3 as this project would <br />not have any adverse significant effects on the environment. <br />Resolution No. 1728 was then entered and adopted. <br />ROLL CALL VOTE: <br />Ayes <br />Noes <br />Abstain <br />Commissioners Doherty, Geppert, Getty, Wilson and <br />Chairman Jamieson <br />None <br />None <br />A motion was made by Commissioner Geppert, seconded by Commissioner Wilson that RZ-79-3 <br />be recommended for approval. <br />Resolution No. 1729 was then entered and adopted to recommend to City Council <br />approval of RZ-79-3 as petitioned and that this property be zoned RM-2500. <br />ROLL CALL VOTEā¢ <br />Ayes Commissioners Doherty, Geppert, Getty, Wilson and <br />Chairman Jamieson <br />Noes None <br />Abstain None <br />UP-79-06, Burger King <br />Application of the Burger King Corporation for a conditional use permit to allow the <br />construction and operation of a drive-through service window at their recently approved <br />facility located on the east side of Hopyard Road about 700 feet south of I-580. The <br />site is zoned C-F (Freeway Commercial) District. <br />Mr. Harris explained the staff report and their recommendation to approve this project <br />subject to the adoption of the ordinance amending the Commercial Districts being adopted.. <br />He pointed out there would still only be one access point onto Hopyard. He stated <br />that staff feels all findings can be made in granting this use permit. <br />Public hearing was opened. <br />Brad Hirst, representing Burger King and W. R. Grace Development Corporation,- the <br />applicants, stated he concurred with the staff report and indicated the only reason <br />the application wasn't made earlier was because a drive-through wasn't allowed under <br />the previous zoning of the C-F District. <br />There being no questions of the applicant's representative, the public hearing was <br />closed. <br />-3- <br />
