George Bing, Conservation Chairman, Sierra Club, 4128 Colegate, Livermore, <br />spoke stating he represented the Club. He spoke in opposition to the <br />development because they wanted the open space maintained. <br />The public hearing was then closed. <br />Commissioner Wilson spoke to certain apparent inequities concerning pro- <br />perty in the City as opposed to the County. He stated that in looking at <br />existing houses which haven't moved, he believed that to be more con- <br />clusive than the geologists reports. He stated he drove his personal <br />vehicle up Longview and had no trouble. He stated erosion gets worse <br />every winter, storm drains are not carrying water but eroded materials <br />and if this second phase isn't completed, there will be more erosion and <br />Phase 1 will never be able to be maintained. Commissioner Doherty stated <br />mitigation measures can be made to get around the environmental concerns <br />and site specific studies should be made. Commissioner Getty stated <br />she concurs with Commissioners Doherty and Wilson. Her further concern <br />is that house purchasers be aware of the conditions existing in the area. <br />Commissioner Geppert spoke to the testimony and documents given stating <br />that he basically agrees with Commissioner Wilson and the rest of the <br />Planning Commission. Chairman Jamieson stated that with regard to <br />staff's recommendation that we get another geologist to mesh the opinions <br />would only result in this project ending up right back where it is now <br />and he feels a decision should be made allowing sufficient time for the <br />decision. <br />Mr. Harris stated he felt insecure about recommending approval of this <br />project with facts and testimony given to date. Harvey Levine, City <br />Attorney stated that if the Planning Commission accepts the site as <br />stable they must address the EIR and the assessments. He pointed out that <br />the staff has not attached the full conditions as they usually do when <br />they recommend approval and that if the Planning Commission approves this <br />project they can add conditions and also conditions can be added by City <br />Council. Reference was made to the agreement between Dr. Long and the <br />homeowners. Mr. Harris stated most of these are not proper conditions of <br />Commission approval but rather those of CC&Rs. Commissioner Doherty <br />suggested that all of the usual conditions for this type of development <br />be incorporated into the approval. <br />Mr. Maines again addressed the Commission stating that when property <br />changes ownership, the new owners can be kept abreast of the prevailing <br />situation and conditions if the soils report were recorded with the <br />County Recorder and the conditions would come to light on the title search <br />report done at the time any property changes ownership. He then offered <br />a list of 23 conditions for review by the Commissioners which they could <br />incorporate into a resolution if it was so required. Commissioner Geppert <br />then read a list of findings and 32 conditions which he prepared for <br />consideration should this application be approved. City Attorney Harvey <br />Levine stated that Mr. Geppert's conditions and findings were a good <br />start and that Council may wish to add to them. <br />Commissioner Doherty made a motion that the EIR for the subject PUD has <br />been completed in compliance with CEQA and State Guidelines. Commissioner <br />Geppert seconded this motion. <br />-9- <br />
