Peter Turner, attorney for the applicant, spoke stating he didn't much <br />care what was done with the five acres. <br />Commissioner Leppert stated the problem he has with the proposal is that <br />modifications build modifications and then justify further modifications. <br />Commissioner Wilson stated that the developer by dedicating the site for <br />parks would pay that much less in cash and dedication fees. <br />Linda Kratcho stated she felt the land should be kept as is. <br />The public hearing was closed. <br />Mr. Harris addressed the Commission stating McManus has not offered the <br />land. He stated the City Council's present position is that we have more <br />park land than can be developed or maintained and the City wants the fees. <br />Commissioner Geppert then made a motion to deny GP-79-3 making the recom- <br />mendation to City Council that this General Plan Amendment not be approved. <br />This motion was seconded by Commissioner Wilson. <br />Resolution No. 1.720 was then entered recommending denial to City Council <br />of GP-79-3. <br />Roll Call Vote <br />Ayes: Commissioners Doherty, Geppert, Wilson and Chairman Jamieson <br />Noes: Commissioner Getty <br />Absent: None <br />Abstain: None <br />After the vote, Harvey Levine, City Attorney pointed out that the "land <br />swap" idea came from the City and not McManus and that the request for <br />General Plan Amendment of the 5 acres originated from the City Council. He <br />stated that allegations made by Mr. Kratcho, the first speaker in opposi- <br />tion to this proposal are unfair and untrue. <br />GP-79-1, Ponderosa Homes <br />Application for a General Plan Amendment to change the land use designation <br />of a 9.8 acre site located between Hansen Drive and Paseo Santa Cruz <br />immediately west of Valley Avenue from "High Density Residential" to <br />"Medium Density Residential." A negative declaration of environmental <br />impact was also considered. <br />Mr. Harris explained the staff report stating the staff has no problems <br />with this proposal. <br />The public hearing was opened. <br />Commissioner Wilson spoke concerning the 42 lots being on the multiple site <br />or actual site. Mr. Harris stated the other site is a commercial site <br />and owned by John Mackay and that consideration should be given to looking <br />at the multiple site in the future regarding designation from commercial <br />to some other General Plan designation because staff feels that the pro- <br />perty may not be appropriate for commercial development. <br />-4- <br />
