Planning Commission <br />May 9, 1979 <br />Page 8 <br />Commissioner Getty spoke to how the people would react when told they cannot have <br />fencing along their backyards. Frisbee responded there would be a fairly large area <br />of open space behind the houses. <br />The public hearing was closed. <br />Commissioner Getty inquired how many lots would be sold to private persons for custom <br />homes and addressed concerns of empty lots between homes for long periods of time. <br />Mr. Frisbee responded with todays market he didn't believe this would be a problem. <br />A motion was made by Commissioner Geppert, seconded by Commissioner Jamieson that the <br />Commission has reviewed the EIR in accordance with CEQA and that there are significant <br />impacts but that they will be mitigated with conditions of approval and all findings <br />could be made for approving the EIR. <br />unrr re-rT <br />Ayes: Commissioners Geppert, Getty, Jamieson, Wilson and Chairman Doherty <br />Noes: None <br />Resolution No. 1742 was then entered and adopted concerning the EIR for PUD-77-10. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner Geppert that <br />PUD-77-10 be approved subject to conditions outlined in the staff report with changes <br />to conditions 1(a), 1(b), 3, 6, 10, 12, 16, 25, 26 and the addition of 431 that <br />a final house siting plan be approved by the Planning Division prior to issuance of <br />building permits. <br />ROLL CALL VOTE <br />Ayes: Commissioners Geppert, Getty, Jamieson, Wilson and Chairman Doherty <br />Noes: None <br />Resolution No. 1743 was then entered and adopted recommending approval of PUD-77-10. <br />PUD-79-3, W. R. Grace Development Corp. <br />Application of W. R. Grace Development Corp. to rezone a 1.75 acre site located at <br />5305 Hopyard Road from the C-F (Freeway Commercial) District to the PUD (Planned <br />Unit Development) District and specifying particular commercial uses allowable in <br />the PUD District. The Planning Commission may rezone the property as requested or <br />to any other designation consistent with the General Plan. A negative declaration of <br />environmental impacts will also be considered. <br />Mr. Harris explained the staff report. He stated the staff report shows C-S but that <br />it is properly C-F. <br />As there were no questions of staff, the public hearing was opened. <br />Mr. Brad Hirst, was present representing the applicant and said they concurred with <br />the staff report. <br />Public hearing was closed. <br />A motion was made by Commissioner Jamieson, seconded by Commissioner Wilson that this <br />project would not have any significant adverse effects on the environment and that the <br />negative declaration be approved. <br />ROLL CALL VOTE <br />Ayes: Commissioners Geppert, Getty, Jamieson, Wilson and Chairman Doherty <br />Noes: None <br />-8- <br />. _._... .,.... _...r._,... _ __._ _ _ . <br />
