PLANNING COMMISSION <br />Page 9 <br />application of Pioneer Chicken~be denied because all of the required findings could <br />not be made in granting a conditional use permit. <br />ROLL CALL VOTE <br />Ayes: Commissioners Leppert, Getty, Jamieson, Wilson and Chairman Doherty <br />Noes: None <br />Resolution No. 1788 was then entered and adopted denying UP-79-18, Pioneer Chicken. <br />The applicant was then advised he had 15 days in which to appeal the decision of the <br />Planning Commission to the City Council. <br />GP-79-17, Iver Hilde and Walter R. Wallner <br />Application of Ivey Hilde and Walter R. Wallner for an amendment to the General Plan <br />which would change the land use designation of the one acre parcel of land located on <br />the east side of Santa Rita Road immediately north of the fire station from "High Density <br />Residential" to "Commercial and Offices". The Planning Commission may recommend the <br />above change or any other designation it deems appropriate. A negative declaration of <br />environmental impacts will also be considered. <br />Mr. Harris explained the staff report and recommendation of denial addressing the loss of <br />high density residential land in the City. He also reiterated the City Council policy <br />concerning removal of high density without considering an alternate site. <br />Commissioner Geppert asked what the City was doing to find alternates. Mr. Harris responded <br />that it is on the City's list of 'things to do'. <br />Commissioner Wilson stated he is opposed to giving up any more multiple sites to <br />commercial and that there is a problem putting multiples somewhere else. <br />The public hearing was opened. <br />Wally Glallner, partner to the application addressed the Commission. He stated he believed <br />there were overriding considerations concerning this property and that it was better <br />suited to be an office as opposed to condominiums as it is next to the firehouse and that <br />an office would have less impacts on the surrounding houses than would multiples. He <br />stated that an office would have real estate and other professional-type businesses in it. <br />He stated that the homeowners surrounding this property were not opposed to their proposal. <br />Mr. Anderson, President of the Homeowners Association, 4469 Fairlands Drive, spoke for <br />the change to "Offices" stating they support this application entirely. <br />The public hearing was closed. <br />Commissioner Jamieson stated since there was no objection from the homeowners and because <br />he didn`t think 16-17 units would make a great deal of difference in the traffic he <br />would support the application for a land use change. Commissioner Getty stated she agreed <br />with the staff recommendation of denial. Commissioner Geppert stated he had concerns <br />with alternate sites for multiple units. Chairman Doherty spoke to traffic concerns <br />but that the senior and young citizens of this community need a place to live. He <br />stated he didn't want to chip away at the rental units. He stated this area is properly <br />zoned. <br />A motion was made by Commissioner Leppert, seconded by Commissioner Getty that the <br />negative declaration prepared for GP-79-17 be accepted for this project. <br />ROLL CALL VOTE <br />Ayes: Commissioners Leppert, Getty, Jamieson and Chairman Doherty <br />Noes: Commissioner Wilson <br />,-_ <br />
