PLANNING COMMISSION <br />October 10, 1979 <br />Page 2 <br />UP-79-14, McDonalds <br />Application of McDonald's for a conditional use permit to allow the construction and <br />operation of a drive-in restaurant facility on a 1.6 acre site located at the northeast <br />interesection of Pimlico Drive and Santa Rita Road. The site is zoned C-F (Freeway <br />Commercial) District. A negative declaration of environmental impacts was also considered. <br />Mr. Harris explained the staff report and recommendation of approval. <br />The public hearing was opened. <br />Bill Hirst, 147 Bernal Avenue, attorney for the applicant spoke addressing this application. <br />He stated this application is for a freeway oriented use and McDonald's policy and efforts <br />to have a family-oriented image with a history of policing their stores to maintain this <br />image. He further stated that the site is individual and not part of a larger site or <br />shopping center. He indicated the City would benefit with funds being generated by sales <br />tax; that a traff is engineer was hired at McDonald's expense approved by the City; and that <br />McDonald's has made every effort to cooperate and comply with City requests. He stated <br />they concur with the staff report except they would like to have the stipulation that the <br />striping cost not exceed $1,000 on Pimlico with a time limitation of one year; and that <br />concerning the traff is signal the applicant feels assumptions made by the traffic engineer <br />projecting traffic flows was really overstated in that McDonald's would not contribute a <br />large traffic flow to the area and that McDonald's would like to see a maximum of $8,000 <br />held for signalization and not $9600 as requested by staff and that a five year limit be <br />put on this request. <br />Speaking in Opposition to this application - <br />Bill Lenson, 3767 Brockton Court stated he had concerns with turning left across Santa <br />Rita Road to go east onto I-580 and that it is dangerous now and this factor would increase <br />when McDonalds is built. He urged the Commission to carefully study the traffic report <br />presented. <br />Mr. Alan B. Campbell stated in talking with Cal-Trans that they (Cal Trans) have no plans <br />for signalization at, this time. He further stated that there was no reason the City should <br />put a 5-year time limit on the signalization and returning funds of McDonalds should the <br />signalization not be completed within that time. <br />Commissioner Getty addressed striping and Mr. Campbell stated the City would have no objection <br />to a one year limit. <br />The public hearing was closed. <br />Commissioner Getty addressed the need for bike lanes for the residents of the area. <br />Mr. Harris stated there was a condition to stripe a bike path on the previous staff report <br />without additional paving; and at that time the Commission asked for a traffic study to be <br />done. This study was taken into consideration and the bike path removed accordingly. <br />He stated it didn't seem fair to have McDonald's pay for a new paved bike lane entirely. <br />Discussion then ensued concerning bike paths in this area between Commissioners Jamieson, <br />Getty and City Engineer, Alan B. Campbell. Mr. Campbell stated bike paths are considered by <br />the City but are prioritized with other public improvements. Commissioner Wilson stated he <br />didn't see any problem in striping bike paths when the street is widened. Commissioner <br />Getty reiterated her opinion that something needs to be done. <br />Chairman Doherty stated he didn't see any reason to put a $1,000 limit or a one year time <br />limit concerning this nor did he see any reason to reduce the $9600 to $8000 and have a <br />5-year time limit on the signalization of the intersection. <br />The public hearing was reopened to allow Jim Keeney, 3471 Windsor Court an opportunity to <br />speak. Mr. Keeney had a prior commitment and arrived late at the meeting. He spoke in <br />-2- <br />
