MEETING OPEN FOR ANY MEMBER OF THE AUDIENCE TO ADDRESS THE PLANNING COMMISSION <br />No one addressed the Commission. <br />REVISIONS AND OMISSIONS TO THE AGENDA <br />Mr. Harris stated that there are no revisions or omissions. <br />MATTERS INITIATED BY THE COMMISSION MEMBERS <br />Commissioner Lindsey stated he would abstain from considering case UP-80-9, <br />Item 6(a) inasmuch as his child attends the daycare center of the Tyrrells. <br />UP-80-9, Bette Ann Tyrrell <br />Application of Bette Ann Tyrrell for a conditional use permit which would <br />allow a daycare center to be operated at her residence which is located <br />at 1776 Harvest Road. The property is zoned R-1-6500 (Single-Family <br />Residential) District. <br />Mr. Harris explained the staff report and recommendation of approval. <br />The public hearing was opened. <br />John Garvan, attorney representing the applicant spoke. <br />He addressed condition #7 and requested that it be eliminated in view of <br />the fact that it was determined earlier by the Board of Adjustment that <br />the garage is a legal, non-conforming use. <br />Concerning the hours in condition #5, he stated the hours were okay but <br />would like it understood that from time to time there are exceptions when <br />a person gets put in an emergency situation and cannot be there on time. <br />Commissioner Wilson stated emergencies are recognized. <br />Mr. Garvan stated that Mrs. Tyrrell has babysat since 1966 and she has <br />taken care of 12 children during this time and that they are not doing <br />anything new which would subsequently change the environment or add to <br />traffic conditions. He stated the State recently has been made aware of <br />babysitting within the City and is requiring them to be properly licensed. <br />He made reference to Ordinance No. 309 which appeared to allow this use <br />as an incidential home occupation. <br />Mr. Harris asked for clarification of the statement made. Mr. Garvan <br />clarified the statement and Mr. Harris explained that the use permit <br />replaces the home occupation permit, therefore, a separate home occupation <br />permit is not required. <br />Mr. Garvan then asked for all people in the audience in favor of the <br />project to stand. Many people stood in support of the application. Mr. <br />Garvan then presented a petition with 12 signatures which reads as follows: <br />"We, the undersigned homeowners at the addresses listed below, do hereby <br />wish to advise the Planning Commission that each of us has no objection <br />to a continuation of Mrs. Tyrrell's childcare services, including her <br />use of a converted garage for the purpose of a playroom. Such childcare <br />services have not been offensive to us in the past and, if continued in <br />the same manner, should not be objectionable to us in the future." Mr. <br />Garvan presented a plot map whereon each petitioner's name was written <br />-2- <br />.. ......_..,. ..~ .. .... ..... .. .. .... ~ _..._... .......r.... ... ...- ... ... ... <br />
