wanted the wording changed in Condition No. 12 whereby "That the
developer call for final building inspection by the City prior to
any of the model homes being converted for residential occupancy or
at such time as agreed to by the staff." Chairperson Wilson made
the statement that the sale and leaseback arrangement is a common
business transaction. Mr. Harris made the comment that they are only
allowed to construct 50 houses per year and they would perhaps now
end up with 55. Ms. Hanson stated she also would like Condition No.
14 to reflect "residential" use of the models as opposed to "to
use of the models."
The public hearing was closed.
A motion was made by Commissioner Doherty, seconded by Commissioner
Jamieson that case UP-80-38 be approved subject to the staff report,
with the changes as requested because all the required findings could
be made to grant this conditional use permit.
ROLL CALL VOTE
Ayes: Commissioners Doherty,
Chairperson Wilson
Noes: None
Getty, Jamieson, Lindsey and
Resolution No. 1939 was then entered and adopted approving case
UP-80-38.
UP-80-41, Heritage Investments
Application of Meadow Plaza Associates for a use permit which would
allow a supermarket and hardware store at their proposed shopping center
to be located on a 7.8 acre site located on the southeast corner of
West Las Positas and Santa Rita Road. The property is zoned C-N
(Neighborhood Commercial) District.
Mr. Harris reviewed the project stating that it is merely a re-
application of a previously approved, expired proposal.
The public hearing was opened.
Glenn Kierstead, representing Heritage Investments, stated he concurs
with the staff report and urged the City do something to their Ordinance
Code which allows for extensions of lapsed projects during this time
of high interest rates and restrained loans.
Chairperson Wilson asked Mr. Kierstead if he was ready to proceed with
the project. Mr. Kierstead stated they were working on a 20$ interest
loan. Commissioner Getty stated she feels the Planning Commission
should be allowed to review expired projects. Commissioner Jamieson
said that once the Planning Commission approves a project, they should
be able to stand by their decision.
Discussion then ensued between Mr. Harris and the Commissioners about
methods to accomplish extensions of approved projects.
-16-
.....~___ T.._...__..f.. _.._..... _.. _..
