Chairperson Wilson made <br />the statement that the sale and leaseback arrangement is a common <br />business transaction. Mr. Harris made the comment that they are only <br />allowed to construct 50 houses per year and they would perhaps now <br />end up with 55. Ms. Hanson stated she also would like Condition No. <br />14 to reflect "residential" use of the models as opposed to "to <br />use of the models." <br />The public hearing was closed. <br />A motion was made by Commissioner Doherty, seconded by Commissioner <br />Jamieson that case UP-80-38 be approved subject to the staff report, <br />with the changes as requested because all the required findings could <br />be made to grant this conditional use permit. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, <br />Chairperson Wilson <br />Noes: None <br />Getty, Jamieson, Lindsey and <br />Resolution No. 1939 was then entered and adopted approving case <br />UP-80-38. <br />UP-80-41, Heritage Investments <br />Application of Meadow Plaza Associates for a use permit which would <br />allow a supermarket and hardware store at their proposed shopping center <br />to be located on a 7.8 acre site located on the southeast corner of <br />West Las Positas and Santa Rita Road. The property is zoned C-N <br />(Neighborhood Commercial) District. <br />Mr. Harris reviewed the project stating that it is merely a re- <br />application of a previously approved, expired proposal. <br />The public hearing was opened. <br />Glenn Kierstead, representing Heritage Investments, stated he concurs <br />with the staff report and urged the City do something to their Ordinance <br />Code which allows for extensions of lapsed projects during this time <br />of high interest rates and restrained loans. <br />Chairperson Wilson asked Mr. Kierstead if he was ready to proceed with <br />the project. Mr. Kierstead stated they were working on a 20$ interest <br />loan. Commissioner Getty stated she feels the Planning Commission <br />should be allowed to review expired projects.
