Tract 4781, Foothill Associates <br />Application of Foothill Associates for tentative map approval for <br />Tract 4781, for a proposed 16 single-family lot subdivision of <br />approximately 9.8 acres of land located at the northeast corner of <br />Muirwood Drive South and Foothill Road. Zoning for the property is <br />R-1-20,000 (Single-Family Residential) District. A negative declara- <br />tion of environmental impacts was also considered. <br />Mr. Harris explained the staff report. <br />Chairperson Wilson asked if this was Catholic Church property. <br />The public hearing was opened. <br />Chuck Schneider, the applicant and engineer spoke. He stated they <br />find all conditions listed acceptable except that he felt there isn't <br />a need for sidewalks in the area of the short cul-de-sac; the water <br />line doesn't run in the easement and he would like to have assurances <br />by the City that if the water line is broken at some point and the <br />tennis courts must be disturbed, the City will repair them at their <br />expense. He said he doesn't expect the City to pay for relocation of <br />the easement, but does want an assurance the City would pay for any <br />repairs necessary to the tennis court if the waterlines should need <br />repair. Mr. Warnick said this could be worked out. <br />Commissioner Jamieson asked about fences and Mr. Schneider stated the <br />tennis courts will require 10 ft. fences. Mr. Harris stated a variance <br />would be required for fences this high. Mr. Schneider said that only <br />four lots will have access to the tennis courts. <br />Commissioner Getty asked about the street lights and Mr. Warnick <br />stated they are satisfied with the street light layout. <br />A motion was made by Commissioner Getty, seconded by Commissioner Lindsey, <br />that the negative declaration for Tract 4781 be approved. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson, Lindsey and <br />Chairperson Wilson <br />Noes: None <br />Resolution No. 1959 was then entered and adopted approving the negative <br />declaration for Tract 4781. <br />A motion was then made by Commissioner Getty, seconded by Commissioner <br />Lindsey that Tract 4781 be approved subject to the conditions of the <br />staff report, but eliminating the sidewalks in the short cul-de-sac. <br />-14- <br /> <br />
