Commissioner Lindsey addressed the vanpool condition. Mr. Geingrich stated that in principle everyone is in agreement, he just doesn't want to have to guarantee use of the vanpools. Commissioner Lindsey stated he is satisfied with the design of the building. Mr. Harris stated that the maximum cut would be about 5 ft. Chairperson Wilson stated that Condition No. 11 addresses excavating the hill. Mr. Harris pointed out that this condition is to ensure excavation will not take place on the toe of the slope of the ridge adjacent to the building on the southwest. A motion was made by Commissioner Getty, seconded by Commissioner Lindsey, that the Mitigated Negative Declaration prepared for case PUD-81-2 be recommended for approval inasmuch as Conditions No. 48 through No. 57 of Resolution 1999 which are imposed on this project would reduce any adverse environmental impacts to insignificant. A motion was then made by Commissioner Getty, seconded by Commissioner Lindsey that case PUD-81-2, be recommended for approval subject to the conditions shown in the staff report of 5/20/81 amending Conditions No. 37 and No. 52 as follows: "If the house on the east side of Dublin Canyon Road across from the subject property remains occupied during the construction of the subject property and the reconstruction of Dublin Canyon Road, the road widening necessary in this area shall take place entirely on the Farmers Insurance property because of the present minimal setback of the house from the road unless otherwise approved by the City Engineer." "That there shall be no occupancy of the building until the City's elevated stream apparatus is in operation unless otherwise approved by the Fire Chief."
