Minutes <br />Planning Commission <br />6/17/81 <br />This matter was continued to the Planning Commission meeting of July 15, <br />1981, Cultural Arts Center. <br />NEW BUSINESS - Public Hearings <br />Taubman Company,' Inc. <br />Application of the Taubman Company, Inc., for development agreement for <br />four parcels of land including: 43.9+ acres consisting of the eastern <br />and western portion of the area surrounded by Stoneridge Mall Road <br />(APN 941-1201-30); the 7+ acre site on the east side of Foothill Road <br />between Stoneridge Drive and Laurel Creek Way; the 4+ acre site on the <br />north side of Stoneridge Mall Road adjacent to Highway 580 (a portion of <br />APN 941-1201-33); and a .9+ acre site located at the southwest intersection <br />located on the southwest corner of the intersection of Stoneridge Mall <br />Road and Canyon Way. The development agreement would provide for phasing <br />of development of the above listed sites as well as the assurance of <br />existing zoning. <br />Mr. Harris stated that the staff report was prepared by the City <br />Attorney's office and that the agreement would give vested rights to <br />the land owner. <br />Commissioner Wilson said that the staff report is a very good one. <br />Harvey Levine, City Attorney, stated that the agreement was generated by <br />the property owner and covers a vested period of ten years. He explained <br />that this agreement comes about as a result of recent legislation. <br />Commissioner Lindsey asked concerning Item No. 2 if the developer would <br />be able to add on a large store in the shopping center and would that <br />store have design review approval. Mr. Levine stated that yes they could <br />add a major store, but that height control by the Design Review Board <br />would be limited by the agreement. <br />The public hearing was opened. <br />Mr. Eynck, Taubman Company, stated that the agreement only covers four <br />parcels. Mr. Levine stated that the agreement would give the developer <br />rights concerning uses under zoning for 10 years. <br />Robert Gibney, attorney for Taubman, spoke to the duration of the <br />agreement as shown on Page 2 thereof. <br />Mr. Eynck stated that the nature of the agreement is to suggest orderly <br />development of projects and that there has to be cextain dates for <br />development of the properties. <br />Commissioner Wilson asked about other developers going through this same <br />process. Mr. Gibney stated that if all .parties are in agreement, they <br />would go through the same process. Commissioner Wilson spoke to sewer <br />permit expiration dates of the developments. He stated he didn't want <br />Pleasanton to lose sewer permits to Dublin. He asked if one of the parcels <br />was sold would the agreement run with the land? Mr. Levine said it would. <br />Commissioner Wilson then asked if Kaiser had closed escrow and Mr. Gibney <br />said it has and that a representative of Kaiser is present at this <br />-2- <br />___. _ _ _ <br />
