Commissioner Doherty expressed his view that this is ex post facto <br />on an existing use and it would set a badprecedent allowing some- <br />one to come in and change the uses for a particular area. He cannot <br />support it in any way, shape or form. <br />Commissioner Lindsey reiterated the above and stated that if there <br />is a problem with Interstate Laundry, it should be handled with them <br />and not by changing the ordinance. He does not like the overtones <br />and is very definitely opposed to the change. <br />The public hearing was opened. <br />William Herlihy, 816 Abbie Street, Pleasanton, spoke in opposition <br />to the change and said it was a threat to the business community <br />of Pleasanton. The revision will place any business in jeopardy <br />and create an uncertain ~~'e for businesses. He felt this measure <br />was not in the interest of the community. <br />Craig Smith, consultant for Interestate and resident of Pleasanton, <br />446 Junipero Street, presented information regarding the relative <br />radioactivity of various common substances, such as a car battery <br />and the natural soil of Pleasanton, and indicated they were more <br />radioactive than anything the laundry puts out. <br />Debra Strong of the Pleasanton Chamber of Commerce indicated the <br />Chamber was opposed to changes to the C-S District and that Article <br />23 was a potential threat to the community. <br />The public hearing was then closed. <br />Commissioner Lindsey, seconded by Commissioner Jamieson, moved to <br />deny recommending revision of Article 23 to the City Council. <br />Mr. Harris stated that even though the Commission denied the above <br />that it will have to go to the City Council because they initiated <br />the matter. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Resolution No. 2022' was entered and adopted denying Case RZ-81-7. <br />Report on Changes to the C-S District <br />Commissioner Lindsey, seconded by Commissioner Jamieson, then <br />recommended denial of item 7a, which is recommended changes to <br />the C-S (Commercial Service) District. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />-8- <br />
