Commissioner Doherty asked Mr. Corley if he or his client had offered <br />or shown interest in the purchase of the subject property. Mr. Corley <br />said no, they hadn't offered to purchase the property. <br />Andrew McCall, Abbie Street, spoke. He addressed the rose garden and <br />asked the dimension when this project is completed. Mr. Harris stated <br />he thought it would be one-half to two-fifths the present size. <br />Commissioner Getty asked if the project didn't propose to use some <br />of the roses in their landscaping plan. Mr. Harris stated they did. <br />Mr. McCall asked if the lease between Southern Pacific and the City <br />had a cancellation clause. Mr. Harris said it has been awhile since <br />he looked at the proposal and couldn't say for sure. Mr. McCall <br />said he is pleased to see the Commission is concerned with preserving <br />the parks. He concurred with the statements of Commissioner Doherty <br />stating this may be the only leverage the City has for the retention <br />of the parks. He said elderly and other citizens enjoy the parks. <br />The public hearing was closed. <br />A motion was made by Commissioner Lindsey, seconded by Commissioner <br />Jamieson, that the mitigated negative declaration be approved in- <br />asmuch as conditions imposed on the project approval will reduce <br />any significant environmental impacts to insignificant levels. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Jamieson, Lindsey, Wilson and <br />Chairperson Getty <br />Noes: None <br />Absent: None <br />Abstain: None <br />Resolution No. 2081 was then entered and adopted recommending <br />approval of the mitigated negative declaration. <br />A motion was then made by Commissioner Doherty, seconded by Commissioner <br />Lindsey, that case PUD-81-28 be recommended for approval subject to <br />the conditions of the staff report with the following changes: <br />3. That the applicant acknowledge that the 19 shaded <br />parking spaces shown on parcel 1 as "private parking" <br />shall be for the use of the law offices immediately <br />to the west of that parcel and Hap's restaurant and <br />that the entrance to this area may be barricaded <br />each weekday and all but the 5 s aces reserved <br />for Hap's restaurant shal be open for the use <br />of depot restaurant customers in the evenings. <br />23. That the developer install street frontage improve- <br />ments per ordinance and to the satisfaction of the <br />City Engineer. These improvements to include, but <br />are not necessarily limited to grading, curb and <br />gutter, sidewalk paving, storm drainage, sanitary <br />sewer, water facilities, street lighting, under- <br />ground utilities, traffic control signing and <br />reconstruction of curb returns to a larger radius. <br />-7- <br />_. _, __ _ ..r,.-,..... _ _ _._._....,._.__ , <br />
