Chairperson Lindsey asked Mr. Cross if he feels he has the cooperation <br />of Texaco and Mr. Cross stated he feels he does. He stated his <br />initial approach to Texaco resulted in them telling him that a <br />produce stand would go in and the second approach they told <br />him a nursery would go there. <br />Commissioner Getty asked about fencing, Mr, Harris stated nothing <br />would be achieved by additional fencing. <br />Commissioner Doherty indicated his concerns were the same as <br />stated by other Commissioners, He said he would like to protect the <br />City with regard to unforeseen items and would want to review a <br />conditional use permit at least two years or maybe after one year of <br />operation, Mr, Cross asked that he not be judged by his predecessors. <br />The public hearing was closed. <br />Chairperson Lindsey stated that staff has put a lot of stringent <br />conditions on this case and he agrees with the other Commissioners <br />that the Commission should have the right to review this case <br />after a period of time. He said it would not be their desire to <br />change anything but simply to make sure that we don't run into some <br />of the problems that have been experienced in the past, <br />Commissioner Jamieson asked if Mr, Cross could break the lease after a <br />given period of time. Mr. Cross said he could break the lease in <br />three years. <br />Chairperson Lindsey indicated the use should be reviewed in one year <br />for a progress report. <br />Commissioner Doherty then addressed the number of bays and whether or <br />not that would be economically viable to have two bays. Mr, Cross said <br />he certainly hoped it was viable, <br />A motion was made by Commissioner Jamieson that all required findings <br />are made as stipulated in the staff report and that case UP-82-24 <br />be approved subject to the conditions shown thereon, This motion <br />was seconded by Commissioner Doherty. <br />ROLL CALL VOTE <br />Ayes: Commissioners Doherty, Getty, Jamieson and <br />Chairperson Lindsey <br />Noes: None <br />Absent: Commissioner Wilson <br />Abstain: None <br />Resolution No. 2258 was then entered and adopted approving case <br />UP-82-24 subject to the conditions of the staff report amending <br />Condition No, 3 to provide that the application shall be reviewed <br />one year from the date of commencement of operation, <br />-9- <br />
