P/C <br />Page 14 <br />2/23/83 <br />Mr. Swift asked the Planning Commission to address conformance with the General <br />Plan concerning this project. <br />Commissioner Getty spoke to Open Space stating that where you are working with <br />five acre lots there is sufficient Open Space. Commissioner Doherty addressed <br />the PUD-Low Density Residential-Open Space District and where you are addressing <br />48 acres of land for 28 parcels there is more than enough Open Space and that this <br />project does conform to the General Plan and zoning of the area. Chairperson <br />Lindsey further stated that the design plan takes into consideration the Open <br />Space segment of the General Plan. <br />A motion was then made by Commissioner Getty, seconded by Commissioner Jamieson <br />that case PUD-82-10 be recommended for approval subject to the conditions shown <br />in the staff report of 2/23/83 with the following changes: <br />1. That the development be substantially as shown on the development plan, <br />Exhibit A, on file with the Planning Division. <br />2. That the developer shall dedicate to the City for street purposes the <br />land necessary for the extension of Crellin Road as a 28' wide street <br />from its terminus as shown on the development plan to the southeastern <br />corner of the subject property. <br />3. This condition was proposed to be eliminated. <br />9. If a homeowners' association is established for the. development, <br />that the CC&Rs of the homeowners' association shall be submitted <br />to the City for review and approval prior to submittal of a final map <br />and that the City shall be named as third party beneficiary of the <br />CC&Rs and granted the power to enforce their provisions if the <br />homeowners' association fails to do so. <br />22. This condition was proposed'to be eliminated. <br />34. That except as modified by this development plan, the site and <br />use standards for the subject property shall be those of the <br />R-1-20,000 District. <br />51.
